Terms & Conditions
Plain language. Fair rules. Last updated October 4, 2026.
1. Using this site
By visiting this site, you agree to use it lawfully and not attempt to disrupt it (scraping at scale, security probes, anything that interferes with normal operation). The content on this site (writing, design, code, imagery) is owned by Sway Rise Creative unless otherwise credited, and is provided for informational purposes only.
2. Engaging us for work
When you commission a project with Sway Rise Creative, a separate signed proposal or statement of work governs that engagement. That document defines scope, pricing, deliverables, timeline, ownership, and any deposit or milestone schedule. These site-level terms cover everything before a project agreement is in place.
3. Quotes and pricing
Pricing shown on this site is current as of the date listed and may change. Final pricing for any project is fixed in the signed project agreement, not on the marketing page.
4. Intellectual property
For commissioned work: ownership of final deliverables transfers to the client upon final payment, per the terms of the signed project agreement. The studio retains the right to display the work in our portfolio, in case studies, and in marketing materials unless you've requested otherwise in writing.
For this site: all original content, copy, design, and code is © Sway Rise Creative. Don't republish or repurpose it without permission.
5. Third-party services
This site links to and embeds tools from third parties (Cal.com for scheduling, our hosting provider, GitHub for code, etc.). Their terms and privacy policies apply when you use those services.
6. No warranties
This site is provided "as is." We try to keep it accurate and online, but we don't warrant that it'll be uninterrupted or error-free. Specific work we deliver under a project agreement has its own warranty terms in that agreement.
7. Limitation of liability
To the maximum extent permitted by law, Sway Rise Creative is not liable for indirect, incidental, or consequential damages arising from your use of this site. Liability under any signed project agreement is governed by that agreement.
8. Governing law
These terms are governed by the laws of the State of Illinois, United States. Any disputes will be resolved in the courts of Cook County, Illinois, unless the project agreement specifies otherwise.
9. Changes
We may update these terms occasionally. The "Last updated" date at the top reflects the most recent change. Continued use of the site after a change means you accept the updated terms.
